Acceptance of terms
By accessing or using AFCloud AI (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
These terms may be updated from time to time. Continued use after changes constitutes acceptance of the revised terms.
Eligibility
You must be at least 18 years old and legally capable of entering into binding agreements. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
Accounts
You are responsible for maintaining the security of your account credentials and API keys. Notify us immediately of any unauthorized use. We are not liable for losses from compromised credentials.
Acceptable use
You agree not to:
- Use the Service to violate any applicable law or regulation
- Attempt to access systems or data you are not authorized to access
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to generate harmful, illegal, or deceptive content
- Resell or redistribute access without written permission
- Interfere with or disrupt the Service or servers
AI-generated content
Outputs generated by AI models may be inaccurate, biased, or incomplete. You are responsible for reviewing and validating all outputs before use. AFCloud AI is not liable for damages arising from AI-generated content.
Billing and payment
Paid plans are billed in your local currency (NGN, KES, ZAR) or USD. Billing cycles are monthly or annual, depending on your selected plan. Fees are non-refundable except where required by law.
Overage charges may apply if you exceed your plan’s token limits. You can set spending limits in your dashboard.
Data and privacy
Your use of the Service is also governed by our Privacy Policy. PII Shield processes are applied to redact sensitive data before it reaches any AI provider. We process data in compliance with NDPR (Nigeria), POPIA (South Africa), and GDPR (EU).
Intellectual property
AFCloud AI retains all rights to the Service, including software, branding, and documentation. You retain ownership of content you submit. AI-generated outputs are licensed to you for your use.
Termination
You may terminate your account at any time. We may suspend or terminate access for violations of these terms or for non-payment. Upon termination, your data will be retained for 30 days then permanently deleted.
Disclaimer
The Service is provided “as is” without warranties of any kind. We do not guarantee uninterrupted or error-free operation.
Limitation of liability
AFCloud AI’s total liability for any claim shall not exceed the amount you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
Governing law
These terms are governed by the laws of the Federal Republic of Nigeria. Disputes shall be resolved in the courts of Lagos State, Nigeria.
